Postal Film Developing Terms of Service

These Terms of Service apply specifically to film sent to Camera Centre UK by post or courier for developing, processing, scanning and related film laboratory services. By placing a postal film developing order and sending film to Camera Centre UK, you agree to these terms. Nothing in these terms affects your statutory rights.

1. Sending Your Film to Camera Centre UK

Customers are responsible for arranging and paying for delivery of their film to Camera Centre UK.

Film sent to us remains at the customer's risk until it has been physically received and accepted by Camera Centre UK at our premises.

Camera Centre UK cannot accept responsibility for film which is lost, delayed, damaged, misdirected or otherwise affected while being transported to us by Royal Mail, a courier or any other delivery provider selected by the customer.

We strongly recommend using a tracked postal service. Using a tracked service provides evidence that your film has been posted and allows you to monitor its delivery to us. For valuable, important or irreplaceable film, customers should consider using a postal or courier service which also provides an appropriate level of compensation or insurance.

The customer is responsible for:

  • securely packaging their film;
  • correctly addressing the parcel;
  • paying the correct postage;
  • selecting an appropriate postal or courier service;
  • retaining proof of postage; and
  • retaining any tracking information.

If your parcel does not arrive at Camera Centre UK, you will need to contact the postal or courier company that you used to investigate the missing delivery and make any appropriate claim. As the customer arranged the incoming delivery, Camera Centre UK cannot normally make a claim against the delivery provider on your behalf.

Where there is a dispute about whether a parcel has been delivered to us, we may ask for tracking information and proof of delivery.

2. When Our Responsibility Begins

Camera Centre UK's responsibility for your film begins once it has been physically received and accepted by us at our premises.

Once your film has been received, we will take reasonable care of it while it is in our possession and while carrying out the services you have ordered.

Where possible, customers will receive confirmation or an order update after their film has been received and entered into our processing system.

A postal tracking status showing "delivered" does not necessarily mean that the film has been received and processed into our system. Please allow reasonable time for incoming postal deliveries to be sorted and entered onto your order.

3. Film Processing

We take reasonable care when handling and processing customers' film. However, photographic film is a physical and sensitive medium and we cannot guarantee that every roll will produce usable photographs.

The final results can be affected by many factors outside Camera Centre UK's control, including:

  • incorrect exposure;
  • overexposure or underexposure;
  • camera faults;
  • shutter faults;
  • incorrect film loading;
  • light leaks;
  • damaged film;
  • expired film;
  • poor storage conditions;
  • heat or moisture damage;
  • X-ray or CT scanner exposure;
  • manufacturing defects;
  • contamination;
  • previous handling;
  • film that has previously been partially or incorrectly processed; and
  • the age and condition of the film.

The presence of blank, fogged, incorrectly exposed, scratched, damaged or otherwise unusable photographs does not by itself mean that the developing service has been carried out incorrectly.

4. Risks Associated With Film Processing

Developing photographic film involves chemical and mechanical processes. Although film processing is highly reliable and we take reasonable precautions, processing physical film carries an inherent risk of damage. Some problems may also only become apparent once the film has been developed.

By submitting film to Camera Centre UK, you acknowledge the inherent nature of photographic film processing. This does not remove Camera Centre UK's responsibility to carry out the service with reasonable care and skill. If you believe your film has been damaged as a result of our processing, please contact us so that we can investigate.

5. Film of Exceptional Importance or Value

We understand that photographs can have significant sentimental, artistic or commercial importance. However, before film is developed it is generally impossible for Camera Centre UK to know what images are contained on it or what personal, sentimental or commercial value those images may have.

If you are submitting film that you consider to be particularly valuable, commercially important or irreplaceable, we recommend contacting us before sending it. No term within these conditions is intended to exclude or restrict liability where doing so would be unlawful.

6. Turnaround Times

Any turnaround time advertised by Camera Centre UK is an estimated target turnaround time rather than a guaranteed completion date, unless we specifically state otherwise.

Turnaround times begin once the film has been received and accepted by Camera Centre UK, not from the date the customer posts the film.

Turnaround times can vary depending on:

  • the number of films we are processing;
  • the film type;
  • processing requirements;
  • scanning requirements;
  • printing requirements;
  • equipment availability;
  • specialist processing;
  • supplier or laboratory delays; and
  • circumstances outside our reasonable control.

Postal delivery time to Camera Centre UK is not included within our processing turnaround time. If you require your film by a particular date, please contact us before sending it. We will do our best to assist, but deadlines cannot be guaranteed unless specifically agreed with us.

7. Blank or Unusable Film

Film developing is a service for processing the film supplied to us. We cannot guarantee that photographs will be present on the film or that the photographs will be correctly exposed or usable.

A refund will not normally be provided solely because a roll produces:

  • blank frames;
  • no exposed photographs;
  • heavily underexposed photographs;
  • heavily overexposed photographs;
  • fogged film;
  • light leaks;
  • camera-related damage;
  • expired-film effects; or
  • other problems which were not caused by the developing service provided by Camera Centre UK.

Where the film has been successfully processed, the developing service has still been carried out even if there are no usable photographs.

8. Film Scanning

Where scanning is included in your order, we will create digital scans from your processed film at the scan quality or service level selected when you placed your order.

Film scanning involves interpretation of a physical negative or transparency. The appearance of scans can vary depending on:

  • the film stock;
  • exposure;
  • development;
  • scanner;
  • scanning settings;
  • colour correction;
  • film density;
  • grain; and
  • the condition of the negative.

Unless a specialist service has been agreed, scans will be produced using our normal laboratory scanning settings. If you believe there is a genuine scanning problem, please contact us and we will investigate it.

9. Digital Files

Where digital scans are included, they will be made available using the download or delivery system specified by Camera Centre UK.

Customers are responsible for downloading their photographs and keeping their own backup. Camera Centre UK should not be relied upon as permanent storage for your photographs. Digital files may be removed from our systems after the storage period stated when you place your order or when your scans are delivered.

We strongly recommend downloading your photographs as soon as they are available and keeping at least one additional backup.

10. Returning Your Negatives

Where return of negatives is included or selected as part of your order, we will prepare the negatives for return using the delivery method selected or specified for the service.

Customers are responsible for ensuring that the return address provided with their order is complete and accurate. Please check your delivery details carefully when placing your order. Camera Centre UK cannot accept responsibility for a return being sent to an incorrect address where the incorrect address was supplied by the customer.

11. Return Delivery

Where Camera Centre UK arranges the return delivery of your negatives, prints or other materials, delivery times provided by Royal Mail or another carrier are estimates unless specifically stated to be guaranteed.

If a return parcel appears to have been lost or damaged during delivery, please contact Camera Centre UK so that we can investigate the matter with the relevant delivery provider. We may ask customers to provide information or photographs to assist with a postal or courier claim. Nothing in these terms removes any rights or remedies that you are entitled to under applicable law.

12. Damaged Return Deliveries

If your returned negatives, prints or other materials arrive visibly damaged, please contact us as soon as reasonably possible. Where possible, we ask that delivery damage is reported within 3 working days so that we can investigate promptly.

Please retain:

  • the damaged items;
  • the outer packaging;
  • the internal packaging; and
  • the postal or courier label.

We may request photographs of these items before we can investigate with the delivery company. The request to report damage within three working days does not remove any statutory rights you may have.

13. Loss or Damage While in Our Possession

Camera Centre UK will take reasonable care of film while it is in our possession. If we become aware that film has been lost or damaged while in our possession, we will investigate what has happened and contact the affected customer.

Any appropriate remedy will be assessed according to the circumstances and your applicable legal rights. We do not attempt through these terms to exclude Camera Centre UK's legal responsibility to provide services with reasonable care and skill.

14. Refunds

If Camera Centre UK is unable to provide a service that you have paid for, we will provide an appropriate refund for the part of the service that we have been unable to supply. If we can only partially complete an order, an appropriate refund may be provided for the affected part of the order. Refunds will normally be returned using the original payment method.

Refunds will not normally be issued purely because:

  • the film contained no photographs;
  • photographs were incorrectly exposed;
  • the film was expired;
  • the camera had a fault;
  • the film had a light leak;
  • the film was already damaged;
  • the customer is unhappy with the photographs they took; or
  • another issue existed independently of Camera Centre UK's processing.

If you believe the developing or scanning service itself has not been performed correctly, please contact us and we will investigate. Nothing in this section affects your statutory rights.

15. Cancellations and Changes

Because developing photographic film is an irreversible process, an order cannot normally be cancelled or changed once development of the film has started. If your film has arrived but processing has not yet begun, please contact us as quickly as possible if you wish to change or cancel your order.

Where statutory cancellation rights apply to an online or distance order, those rights will continue to apply in accordance with UK law. Where you expressly ask Camera Centre UK to begin providing the developing service before the end of an applicable cancellation period, your cancellation rights may be affected once work has started. Once a service has been fully performed following the appropriate request and acknowledgement from the customer, the statutory right to cancel that service may come to an end. Nothing in these terms removes any cancellation right which you are legally entitled to exercise.

16. Customer Content

By submitting film to Camera Centre UK, you confirm that you are legally entitled to possess the film and request that it is developed, scanned or printed.

Camera Centre UK reserves the right to refuse to process, scan, print, reproduce or return material in a particular manner where we reasonably believe doing so would be unlawful. Where required by law, Camera Centre UK may report relevant material to the appropriate authorities.

17. Circumstances Outside Our Control

Occasionally our service may be affected by circumstances outside our reasonable control, including:

  • postal disruption;
  • severe weather;
  • power failures;
  • equipment breakdown;
  • network or IT outages;
  • supplier disruption; or
  • other exceptional events.

Where this happens, we will take reasonable steps to minimise disruption and complete affected orders as soon as reasonably practicable.

18. Your Statutory Rights

Camera Centre UK will provide its film developing and related services with reasonable care and skill. Nothing in these Terms of Service is intended to exclude, restrict or replace rights or remedies which customers have under applicable UK consumer law.
